The attempts at global reform of the century-old Criminal Procedure Law that have taken place in recent years have been halted by the insurmountable obstacle of combining two antagonistic aspects, both referring to the Public Prosecutor’s Office, namely, the mandatory premise of transferring the direction of the criminal investigation, a matter of the greatest importance for police work, together with the evidence that its current design is incompatible with the demands of impartiality and autonomy imposed by the performance of that function. At the same time, with regard to the role reserved for the Judicial Police, the projects published so far use radically different models, based on a merely functional concept or on a functional and organic concept. Keywords Judicial Police; Crime prosecution; Evidence; Prosecutor; Prosecutor’s Office; Court; Security Corps. 1 Introducción La protección de la seguridad ciudadana y el libre ejercicio de los derechos constituyen un binomio inseparable y ambos conceptos son condiciones básicas de la convivencia en una sociedad democrática. La seguridad ciudadana es un concepto que trasciende la mera seguridad jurídica, garantizada en el artículo 9.3 de la Constitución española (en adelante, CE) y aun de la naturalística y policial seguridad pública, a la que se refiere el artículo 149.29.ª del mismo texto constitucional. Viene a ser la armónica y pacífica coexistencia de los ciudadanos bajo la soberanía del Estado y del Derecho, y en tal sentido es sinónima de paz social a la que la propia norma fundamental alude en otro lugar: el artículo 10.1, que preceptúa que “la dignidad de la persona, los derechos inviolables que le son inherentes, el libre desarrollo de la personalidad y el respeto a la ley y a los derechos de los demás son el fundamento del orden político y de la paz social”.
